1. PROCESSING OF PERSONAL DATA
Our goal is that you should be able to feel safe when you leave your personal data to us at Upbeater. We therefore take all reasonable measures to protect your personal data. All processing of personal data takes place based on the provisions of Swedish privacy protection legislation and otherwise based on guidelines that apply to Upbeater's operations.
2. PERSONAL DATA CONTROLLER
Upbeater is the personal data controller for the processing of personal data that takes place within the company and its related operations, and is responsible for regulations regarding the purpose of the processing and the manner in which the processing must take place.
3. DEFINITION AND MEANING
Personal data is any kind of information that can be directly or indirectly linked to a physical living person. Examples of personal data are name, social security number (personnummer), e-mail address, telephone number, contact of next of kin, pictures and IP number. Processing of personal data means all types of handling of personal data, such as collection, registration, storage, transfer and deletion.
4. PROCESSING AND RECORDING OF PERSONAL DATA
Processing of personal data is required, among other things, in relation to contracts, invoicing, bookkeeping, and employment.
4.1 AS A SELF-EMPLOYED FREELANCER AT UPBEATER
For self-employed freelancers at Upbeater, we process personal data that is required to comply with the employment regulations, pay wages, etc. Personal data that is processed is, for example, name, social security number, address, e-mail address, telephone number, bank account number, credit information, receipts on expenses, educational certificates and correspondence.
As we operate as an employer of the Self-Employed, we must provide personal data to e.g. The Swedish Tax Agency (Skatteverket), Sweden’s Central Bureau of Statics (SCB) and other authorities and government organizations. By using Upbeater’s Service, the Self-Employed agrees to accept both the Terms and Conditions for Self-Employed Freelancers, as well as this Privacy Policy which is to be considered an Appendix.
As an employer, Upbeater may also in some cases be required to release information about the Self-Employed to the Customer.
4.2 AS A CUSTOMER OR SUPPLIER TO UPBEATER
As a Customer or Supplier to Upbeater, we process personal data in order to be able to enter into and complete the Project Agreements that have been agreed between the Self-Employed and the Customer. Personal data that is processed is, for example, name, company identification number, address, e-mail address, telephone number, invoicing information, correspondence. By using any of Upbeater’s Services, the Customer agrees to accept both the Terms and Conditions for Companies, as well as this Privacy Policy which is to be considered an Appendix. 5. COLLECTION OF PERSONAL DATA
We collect information about you in relation to your registration and/or use of Upbeater’s Services. When you start using any of our Services you agree to our Terms and Conditions either as Self-Employed Freelancer or as a Company Client as well as this Privacy Policy. Relevant personal data may be collected via our website, forms, e-signing service, e-mail or other correspondence method between Upbeater and the data provider.
While there is an active agreement between Upbeater and the data provider, additional data about you may be generated and registered in our system. For a Self-Employed person, it can e.g. be salary specifications, employment number, control information. sick leave, education certificate, etc. For Customers, it can e.g. be ongoing communication, change of project and assignment, contractual regulation, etc.
In addition to the information that you provide to us yourself or that we collect from you using our Services or corresponding with us, we may also collect information from third parties. Information that we collect from third parties is, for example, credit score and reference information from credit reference agencies and address information from public records.
Cookies are small pieces of text that your browser sends via the website you visit. A cookie file is stored in your browser and allows the service or a third party to recognize you in order to simplify your next visit and make the service more accessible. For example, your language settings and login information can be saved. These are used to improve your user experience and to analyze how you use our service. We also use third-party cookies for our advertising and marketing efforts.
6. DISCLOSURE OF PERSONAL DATA
In some cases and if necessary to be able to fulfill our commitments, we may share your personal data with other legal entities or personal data processors. It can e.g. be to customers, suppliers, or government authorities such as e.g. The Tax Agency (Skatteverket), the Swedish Enforcement Agency (Kronofogdemyndigheten), the Swedish Social Insurance Agency (Försäkringskassan), the Police, the Work Environment Agency (Arbetsmiljöverket), etc. In cases where these are independent personal data controllers, their privacy policies and routines regarding the processing of personal data apply.
We save your personal data for as long as is necessary to fulfill the purpose for which the data was collected, and one year thereafter. The data we collect and which is generated when you use our services are processed for different purposes, therefore they are also saved for different lengths of time depending on what they are to be used for and what our legal obligations look like. It can e.g. be as long as required for us to be able to fulfill our employer responsibilities, agreements, complaint cases from clients or as long as it is required to meet certain statutory storage times regarding, for example, bookkeeping.
8. PROTECTION OF PERSONAL DATA
We take appropriate technical and organizational security measures to ensure that all information that we process is protected from unlawful or unauthorized access, but also from loss, destruction or other damage. Only the administrators who are authorized to our systems and information have access to your personal data and their handling of the information is strictly regulated.
You who have personal data registered with us have legal rights that you can use. These rights mean that you can;
- get a verification that we are processing your personal data
- get a register extract of the data we process
- object to processing or request data portability
- request to limit the processing of your personal data
- have your personal data corrected
- have your personal data deleted
- request withdrawal of consent (with some reservation according to limitation of rights)
Your rights are limited to only being performed to the extent that it does not restrict Upbeater's ability to fulfill its legal obligations, or to only being performed when the data is not needed for other legal purposes. This means that if you have requested action such as deletion, Upbeater must still save and process the personal data that is considered necessary for as long as the applicable law or legal basis so requires. If not all registered data is considered necessary, Upbeater can, however, carry out the desired action for the personal data that is not needed.
10. UPDATING PERSONAL DATA
If you change your name, address or contact information, or become aware of incorrect information, it is your responsibility to change your information so that it is up-to-date and correct. Upbeater aims to maintain accurate information about you and will do everything we can to keep your information up to date. If your personal data is subject to correction or deletion, Upbeater will notify the recipients of your personal data, provided that Upbeater finds it possible and not unreasonably burdensome.

Upbeater reserves the right to change and update this privacy policy if necessary. The latest version of the privacy policy will always be published on our website.
